Introduction

The purpose of this document is to regulate the GENERAL TERMS or PURCHASE CONDITIONS of the Glamping Skies online booking services that are owned by A Essência do Meio, Lda, with address at Caminho da Barreta 100, 7100-715 Veiros, Estremoz.

The terms “You” and “User” are used here to refer to all individuals and/or entities who, for any reason, access the www.glampingskies.com website or use its services.

By using or visiting the Site hosted at www.glampingskies.com (“Site”) or any of the information, data files, written text, graphics, links, audio files or other sounds, photographs, videos or other images (together, “Contents”), resources and services, (together “Services”) available through it, you consent and accept the Terms of Use and Booking Conditions, the privacy and data protection policy available in the Privacy Policy.

Through the Site, A Essência do Meio, Lda gives the User access to the Services. The Services, including updates, developments, new tools and/or new web properties, are subject to these Terms of Use.

A Essência do Meio, Lda reserves the right to change these Terms of Use at any time, without prior notice, and the User is solely responsible for verifying and complying with them at each use. It is expressly prohibited to access the Services and Content for purposes other than those for which the Site is intended, including legal purposes or any other purposes that may harm the image of A Essência do Meio, Lda. The usurpation and counterfeiting of contents, illegitimate identification and unfair competition are punishable as a crime. It is also strictly prohibited to place viruses or any other file that could damage the Site.

Rights and obligations of A Essência do Meio, Lda

A Essência do Meio, Lda reserves the right to:

2.1. Modify these General Contracting Terms and Conditions, informing users of the changes made through the website www.glampingskies.com;
2.2. Modify or terminate the Services for any reason and without notice at any time;
2.3. Modify, replace, refuse access to the Site and Services, suspend or discontinue them, in whole or in part. These changes will take effect from their placement on the Site or from the date of sending any communications.

Limitation of Liability

To the extent permitted by applicable law, A Essência do Meio, Lda assumes no liability to the user for:

3.1. Any damage resulting from:

3.1.1. Any changes that A Essência do Meio, Lda may make to the services or even the permanent or temporary termination of these services (or any functionality of the Service);
3.1.2. The deletion, corruption or storage error of any content or other communications data maintained or transmitted through the Services;
3.1.3. Any viruses or elements in its content that may alter the software or hardware of the user or of people who visit the web pages and, therefore, will not be responsible for damages of any kind that may arise as a result of them.
3.1.4. The lack of availability, reliability or continuity of its website or its services, although it seeks to facilitate, to the extent of its capabilities, technical support for the affected person, and will immediately try to correct the interruption of services, making available, to the extent of its capabilities, alternative means.
3.1.5. Violation (direct or indirect) of these Terms of Use
In the event that the User does not agree, in part or in full, with these Terms of Use for the Site or the Services, he/she only has the possibility to stop using the Site or the Services, as applicable, and to demand the cancellation. of your user account.

Accommodation

4.1. The characteristics of Glamping Skies and its rooms are those mentioned in the reservation. However, considering that the photographic contents present on the Site were not created at the time of booking by the Customer, there may be significant differences between the images and the reality on the date of enjoyment contracted by the Customer, which do not give the Customer the right to any modification of the Agreement.

Prices and Rates

5.1. The price of the stay to be paid by the customer, constitutes the consideration for the availability of the use of the room by adults, in the period between arrival and departure. The total price of the stay will be charged per night, regardless of whether the customer actually made use of the room or spent the night there.

5.2. Rates are valid only if stated in writing and for the specified period. A Essência do Meio, Lda reserves the right to modify these prices without prior notice, whenever there are justifiable reasons.
5.3. Booking rates will be indicated during the booking process. VAT is levied on these prices, without prejudice to local taxes also levied, in accordance with local regulations in the country. The mentioned local taxes must be paid directly to the hotel.
5.4. Prices shown at the time of booking are inclusive of VAT and other applicable fees, at the rate applicable at the time.
5.5. The prices shown include breakfast, parking space, Wi-fi Internet and access to the outdoor swimming pool. The prices charged differ according to the time of booking.
5.6. Confirmation of the value for the date of your stay must be made in the reservation process.
5.7. The accepted means of payment are those available on the website.
5.8. At the time of booking, at the counter or online, the Customer must immediately pay for the entire stay.

Online Booking Services

6.1. The online booking services on the website are intended to reserve a room in the resort for adults only. The use of these services will represent the full and unconditional acceptance, as well as the validity of each of the general terms and/or conditions – which will be considered automatically incorporated into the contract signed with A Essência do Meio, Lda, without their transcription in writing required in the contract – included in the latest version of these general terms and/or conditions.
6.2. Contracting procedure: When using the service, once the payment corresponding to the reservation has been made, the User will receive an e-mail confirming the reservation; this email will serve as proof of booking.
6.3. The refund conditions are linked to the rates applied in the reservations, being as a rule non-refundable.

Check-in and Check-out

7.1. In case the Customer makes the reservation at the Hotel reception, A Essência do Meio, Lda will grant a room depending on the availability of the moment, with check-in to be made from 3 p.m. to 8 p.m..
7.2. The Client must present a Valid Credit Card and personal identification documents upon check-in.

7.3. Upon arrival, the Customer will be asked for a credit card guarantee in the amount of one night’s rate, which will only be used if it is necessary to cover any damage caused by the Customer.
7.4. On the date of departure, the Client must leave the room, leaving it free of people and without any damage, until 12 p.m.. In the event that the customer does not leave the room by 12 p.m., a fee corresponding to a one-night stay will automatically be charged, with only the right to use the room during this period if the hotel has rooms available, otherwise the customer will have to pay the same the fee and leave the room as soon as possible.
7.5. As a rule, the Accommodation can be used from 3 p.m. on the day of arrival and must be left free before 12 p.m. on the day of departure (in both cases, local time). Staying in the Accommodation beyond the check-out time may lead to the payment of additional amounts, which are the sole responsibility of the Client.

Terms of Use

For a good use and functioning of the space, it is necessary to comply with the following Terms of Use:

8.1. The Resort only has non-smoking rooms for adults, with no admission of children.
8.2. Essência do Meio, Lda assumes that only the people indicated in the accommodation reservation will have the right to use the room.
8.3. The User undertakes to use the services in accordance with the Law, moral standards, good customs and public order, as well as with the provisions of these Terms and/or General Contracting Conditions. Consequently, the User is obliged not to use the services for illicit purposes and effects and/or contrary to the provisions of these General Contracting Terms and/or Conditions, in a way that may harm the rights and interests of third parties and that, in some way, , may harm the services, A Essência do Meio, Lda and/or its image.
8.4. A Essência do Meio, Lda may, for greater agility and for the benefit of its users, unilaterally modify, at any time and without prior notice, the services provided or the operational or technical conditions or the conditions of use of the services. Likewise, users, in order to improve the service and establish ideal levels of quality – this being the ultimate goal of A Essência do Meio, Lda – may make suggestions for changes they deem useful, by contacting those responsible for the page through from the following email address: glampingskies@gmail.com
8.5. It is strictly forbidden not to care for and respect the hotel’s spaces.
8.6. Smoking is strictly prohibited in the hotel’s rooms and enclosed areas.
8.7. It is strictly forbidden to take and consume food and drink that are not provided by the hotel, in social and common areas.
8.9. The User undertakes not to take and consume food and drinks that may leave odors and/or compromise the healthiness of the rooms and surrounding spaces.
8.10. The Client must respect other clients and the rules of good conduct imposed by A Essência do Meio, Lda.
8.11. The Customer is not authorized to use the reserved access areas.
8.12. Pets are not allowed to enter and stay on the premises of the Enterprise.
8.13. The Client is entirely responsible for the goods left at Glamping Skies, having the duty to supervise them during their stay.

Payment terms

9.1. The value of the stay and prices for additional services must be paid in advance at the time the Customer makes the purchase, regardless of the billing date.
9.2. If the length of stay is not specified, the price of stay and prices for additional services for each night must be paid in advance by 12 p.m..
9.3. In the case of stays without a specified departure date, non-payment of the price of stay and additional services under the terms of the previous number determines the immediate termination of the contract and immediately forces the customer to leave the room and hand over the respective key to the Resort.
9.4. A Essência do Meio, Lda accepts payment in euros, transfers, and Visa and Mastercard cards. Other payments will only be allowed in exceptional cases, with the consent provided by the Hotel.

Benefits, promotions and discounts

10.1. It is not possible to choose programs/promotional packages that overlap. All rates include VAT at the prevailing rate and are subject to limited availability.
10.2. A Essência do Meio, Lda may carry out on the Site, with a temporarily limited scope or not, certain promotions (“Promotions”) and discounts (“Discounts”) on reservations made by Customers.
10.3. The following conditions apply to Benefits, Promotions and Discounts:

i) For the benefit of certain Promotions and/or Discounts, the Customer may be asked to enter a promotional code (“Promotional Code”) or to prepay the reservation;
ii) Benefits, Promotions and Discounts are subject to availability confirmation;
iii) AA Essência do Meio, Lda reserves the right to cancel the Benefits, Promotions and/or Discounts or to reject a Promotional Code when the total value of the Promotional Codes already used exceeds a certain financial value or when they are used in a fraudulently (namely, by anyone who is not its owner/beneficiary);
iv) The Benefits, Promotions and Discounts are only valid for reservations made through the Site and are not transferable to third parties;
v) In case of cancellation or non-use of a reservation made within the scope of a Benefit, Promotion or Discount, the value of the Benefit, Promotion or Discount will not be refunded, nor will its reapplication in another reservation be guaranteed;
vi) If there is a change, on the Client’s initiative, of the characteristics and/or ownership of a reservation made within the scope of a Benefit, Promotion or Discount, the latter may lose the benefit/perk granted by the reservation.
vii) A Essência do Meio, Lda reserves the right to cancel and/or change the Benefits, Promotions and Discounts at any time.

Claims

11.1. Any notifications, communications and complaints from the User must be made, preferably, to the email [glampingskies@gmail.com]. Complaints can also be made at https://www.livroreclamacoes.pt/inicio .

Personal data

12.1. When completing the reservation form, the Customer will be asked for certain data that can identify him (“Personal Data”), which will be collected by A Essência do Meio, Lda and processed by A Essência do Meio, Lda, in strict compliance with the law and in accordance with the provisions of the Site’s Privacy Policy.

General provisions

13.1. The provisions of these General Conditions may be changed at any time by A Essência do Meio, Lda for future legal relationships, without prior notice. As such, whenever you make a reservation, and even if you frequently use the Site, you must read them in full.

Conflict management

14.1. In the event of a consumer dispute, the consumer may use the European Online Dispute Resolution Platform, available at http://ec.europa.eu/consumers/odr or alternative consumer dispute resolution entities.

Applicable Law and Forums

15.1. These Terms and Conditions are governed by Portuguese Law and the resolution of any dispute arising from the interpretation and execution of these General Conditions will be subject to Portuguese law and courts.
